Russia’s Proton Mail block – New revelations and information

On Jan. 29, the Russian government announced via an official website(new window) that effective immediately, Proton Mail(new window) would be blocked in Russia. (Proton VPN(new window), however, is not blocked.) Since then, we have taken action to address the situation, and today Proton Mail is accessible for many Russian Internet users. However, some users continue to be impacted.

If you are a user in Russia facing this block, we recommend taking the following steps:

  1. Use Proton VPN, our free VPN service(new window). All Proton Mail users have access to Proton VPN: simply download the appropriate VPN app(new window) and log in with your Proton Mail credentials to get started. We advise you connect to a server outside Russia to access Proton Mail.
  2. Use Tor to access Proton Mail. The Tor network routes your Internet traffic through special Tor servers in such a way that makes it extremely difficult to block. We recommend you use the Tor Browser(new window) to access the Tor network.
  3. Complain to MTS(new window), Rostelecom(new window), and the other major Russian Internet service providers. If enough people complain, these ISPs and the Russian government may reconsider their approach.

To continue providing services to our users in Russia, we are currently reaching out to Russian authorities to contest the block as we believe it to be disproportionate, unjustified, and counterproductive. In parallel, we are also working on other solutions that would allow service to be restored without requiring the usage of Tor.

Background

Officially, the block was put in place because bomb threats have been sent to numerous Russian cities via Proton Mail. Blocking access to Proton Mail is an ineffective and inappropriate response to the reported threats. It will not prevent cybercriminals from sending threats with another email service and will not be effective if the perpetrators are located outside of Russia. The cybercriminals will also likely be able to bypass the block using Tor or a VPN, and they will almost certainly have this technical capability. However, the block does deny regular, law-abiding citizens of Russia access to secure email and privacy. That’s why we condemn this block as a misguided measure that only serves to harm ordinary people.

Proton Mail is a well-known privacy and security tool which happens to be the favored email service for portions of the Russian population in favor of a more free and democratic Russia. We have always stood for democracy and freedom, and these bomb threats may just be a convenient pretext to block Proton Mail.

This is not the first time the Russian government has targeted us. In an earlier attempt to block Proton Mail in March 2019(new window), the FSB (Russia’s Federal Security Service) made similar bomb threat claims. That block was only temporary and was swiftly overcome. Unlike the previous time, however, this time the Russian government released an official statement.

Inaccurate statements by the Russian government

In their official statement(new window), the Russian government alleged that we “responded with a categorical refusal to Roskomnadzor’s (the Federal Service for Supervision of Communications, Information Technology and Mass Media) repeated requests for information” and that “Information about the administrators of the mailboxes used to send threats has not been provided.” This is categorically false.

Proton Mail is a Swiss company bound by Swiss laws(new window). Making bomb threats is a crime under Swiss law, and we have a zero-tolerance policy(new window) for criminal acts committed using Proton Mail. We offer our full cooperation with law enforcement authorities on all criminal matters, including those that take place outside of Switzerland, subject to judicial review and approval from Swiss authorities. In 2018 alone, we complied with 76 such foreign requests for assistance, as detailed in our transparency report.

Despite the Russian government’s claims to the contrary, we never received any request for assistance or information regarding the case in question. Furthermore, the Swiss government has also confirmed to us that no such request for assistance was transmitted from Russian authorities. So not only did we not refuse to assist with an investigation, we were never even asked before the Russian government decided to block Proton Mail.

Therefore, the statements from the Russian government are inexplicable to us. There seems to be no justification for why they did not seek assistance under established international procedures. However, since making bomb threats is illegal under Swiss law, despite the absence of information or evidence from the Russian government, an investigation was also opened in Switzerland.

Our investigation confirmed that bomb threats were indeed sent from Proton Mail, and we obtained copies of the emails sent from our systems from third-party sources. All accounts involved have now been identified and permanently disabled. What subscriber information we have has also been preserved as required by Swiss law and can be delivered to Russian authorities upon receipt of an official request through the Swiss Federal Police.

This option has always been available to Russian authorities and their reluctance to reach out to us or to Swiss law enforcement for assistance has only served to hamper the speedy apprehension of the parties responsible for these bomb threats. 

During the previous Proton Mail block in Russia in March 2019, many observers noted that the shutdown might have had more to do with the mass protests happening around Russia at the same time(new window), in which Russian citizens were demanding greater online freedom. There are also strange circumstances surrounding the latest block.

The bomb threats began after BBC Russia obtained documents (reportedly confirmed by two sources) that alleged that approximately $450 million was stolen with the involvement of the FSB and published an investigative report(new window). Follow up investigative reporting(new window) revealed that the bomb threats against Russian cities are likely in retaliation for the FSB’s alleged role in the theft.

Proton Mail is obliged by Swiss law to assist criminal investigations

Irrespective of the true cause, Proton is clearly not responsible for the bomb threats nor an adversary to be blocked. On the contrary, we are committed to helping to bring the perpetrators to justice. As Switzerland generally accepts all legitimate foreign law enforcement requests, and we operate in full compliance with Swiss law, we are also likely the best source of assistance to bring an end to these threats.

We ask that the Russian government reconsider its position and work together with us to resolve this matter through dialog and mutual assistance. It is only through global cooperation that these threats can be eliminated, and we look forward to rendering assistance within the framework of Swiss law.

С тех пор мы предприняли ряд мер и сегодня Proton Mail снова доступен для многих граждан России. Однако, некоторые пользователи могу по прежнему испытывать трудности.

Если вы среди тех, кто все еще подвержен блокировке, мы рекомендуем следующие шаги:

  1. Использовать Proton VPN, наш бесплатный VPN сервис(new window). Просто скачайте наше VPN приложение(new window) и введите ваш логин и пароль. Мы рекомендуем соединиться с сервером за пределами России для доступа к Proton Mail.
  2. Воспользоваться браузером Tor для получения доступа к сервису Proton Mail. При использовании сети Tor ваш трафик будет перенаправляться с помощью специальных серверов Tor, которые существенно усложнят блокирование вашего доступа к сайтам в сети Интернет.   3. Обращайтесь с жалобами в МТС(new window), Ростелеком(new window) и другие крупные Интернет-провайдеры России. Если достаточное число граждан обратятся с жалобами, возможно, эти Интернет-провайдеры и российское правительство пересмотрят свою позицию по данному вопросу.

Чтобы продолжить обеспечивать доступ российских пользователей к нашему сервису, в настоящий момент мы пытаемся наладить связь с российскими органами власти и оспорить решение о блокировке, поскольку считаем эту меру несоразмерной, необоснованной и контрпродуктивной. Помимо этого, мы также работаем над другими вариантами решений, которые позволят восстановить доступ к сервису без необходимости использования браузера Tor.

Контекст

Предполагается, что сервис был заблокирован в связи с сообщениями о минировании объектов в различных городах России, разосланными с использованием сервиса Proton Mail. Блокировка доступа к сервису Proton Mail является неэффективным и нецелесообразным ответом на заявленные угрозы. Она не помешает киберпреступникам рассылать письма с угрозами с помощью других почтовых сервисов и не будет эффективна в случае, если злоумышленники находятся за пределами России. Киберпреступники, вероятно, также смогут обойти блокировку, используя браузер Tor или VPN-сервис, и у них наверняка имеются соответствующие технические возможности. Однако из-за блокировки Proton Mail доступа к защищенному сервису почтовой службы, обеспечивающему конфиденциальность, были лишены простые, законопослушные граждане России. Поэтому мы осуждаем блокировку сервиса как ошибочную меру, которая вредит обычным людям.

Proton Mail представляет собой популярное средство обеспечения конфиденциальности и защиты в сети Интернет, которое, среди прочих, предпочитает та доля населения страны, что выступает за более свободную и демократичную Россию. Мы всегда поддерживали демократию и свободу, а рассылка писем о минировании, возможно, является лишь удобным поводом для блокировки сервиса Proton Mail.

Мы сталкиваемся с препятствиями со стороны российского правительства не впервые. Во время предыдущей попытки заблокировать Proton Mail в марте 2019 года(new window) ФСБ (Федеральная служба безопасности России) также заявляла о подобных письмах с угрозами. Тогда сервис был заблокирован лишь на короткое время, и проблема была быстро решена. Однако в отличие от прошлого инцидента, на этот раз российское правительство опубликовало официальное заявление.

Заявления российского правительства, не соответствующие действительности

В официальном заявлении(new window) российского правительства утверждается, что «на неоднократные запросы Роскомнадзора (Федеральной службы по надзору в сфере связи, информационных технологий и массовых коммуникаций) о предоставлении информации» мы «реагировали категорическим отказом» и что «сведения об администраторах почтовых ящиков, используемых для рассылки угроз, не предоставлены». Эти заявления категорически не соответствует действительности.

Proton Mail является швейцарской компанией, действующей в соответствии со  швейцарским законодательством(new window). В соответствии со швейцарским законодательством рассылка ложных сообщений о минировании является преступлением, и мы придерживаемся политики абсолютной нетерпимости(new window) в отношении любых преступлений, совершаемых с использованием сервиса Proton Mail. Мы стремимся всячески сотрудничать с правоохранительными органами по любым уголовным делам, в том числе уголовным делам, рассматриваемым за пределами Швейцарии, при условии судебного контроля и одобрения со стороны швейцарских властей. Так, в 2018 году мы выполнили 76 запросов о содействии зарубежным расследованиям; подробности о них доступны в «Отчете о прозрачности».

Несмотря на заявления российского правительства об обратном, никаких запросов о содействии расследованию или предоставлении информации по рассматриваемому делу к нам не поступало. Более того, в правительстве Швейцарии также подтвердили, что со стороны российских властей никаких обращений о помощи там получено не было. Таким образом, мы не только не отказывались помочь с расследованием, но российское правительство нас об этом даже не просило, прежде чем заблокировать сервис Proton Mail.

Поэтому заявления российского правительства вызывают у нас недоумение. Мы не видим никаких оснований для отказа обратиться за помощью в соответствии с установленными международными правилами. Однако поскольку в соответствии со швейцарским законодательством рассылка ложных сообщений о минировании является преступлением, в Швейцарии также было начато расследование, несмотря на отсутствие информации или доказательств со стороны российского правительства.

В ходе нашего расследования было установлено, что угрозы взрыва действительно были отправлены с помощью Proton Mail, и нам удалось заполучить копии электронных писем, отправленных с наших систем из сторонних источников. Все задействованные учетные записи были выявлены и навсегда заблокированы. Вся имеющаяся информация об их владельцах была сохранена в соответствии с требованиями швейцарского законодательства и может быть передана российским властям после получения официального запроса через Федеральную полицию Швейцарии.

У российских властей с самого начала была такая возможность, а их нежелание обращаться к нам и швейцарским правоохранительным органам за помощью только помешало быстрому задержанию ответственных за угрозы взрыва лиц. 

Когда сервис Proton Mail был заблокирован в России в прошлый раз в марте 2019 года, многие наблюдатели отмечали, что приостановка работы сервиса могла быть связана с проходившими в то время в стране массовыми акциями протеста(new window), в ходе которых российские граждане выступали с требованиями большей свободы в сети Интернет. Последний случай блокировки также произошел на фоне странных обстоятельств.

Письма с угрозами взрыва начали поступать после того, как в распоряжении Русской службы Би-би-си оказались документы (по сообщениям, подтвержденные двумя источниками) о предположительном участии ФСБ в событиях, приведших к хищению примерно 450 миллионов долларов, после чего было опубликовано соответствующее журналистское расследование(new window). В ходе следующего расследования(new window) выяснилось, что письма о минировании объектов в российских городах, вероятно, были отправлены в отместку на сообщения о роли ФСБ в хищении средств.

В соответствии со швейцарским законодательством Proton Mail обязан оказывать содействие в расследовании уголовных дел

Вне зависимости от истинной причины блокировки сервиса очевидно, что ответственность за угрозы взрыва лежит не на Proton Mail и что сервис не является враждебным сайтом, доступ к которому необходимо запретить. Напротив, мы всячески стремимся содействовать привлечению виновных лиц к ответственности. Поскольку Швейцария, как правило, принимает все законные запросы иностранных правоохранительных органов, а мы действуем в полном соответствии со швейцарским законодательством, то мы, вероятно, могли бы оказать наибольшую помощь для прекращения этих угроз.

Мы призываем российское правительство пересмотреть свою позицию и сотрудничать с нами, чтобы решить данный вопрос путем диалога и взаимопомощи. Конец таким угрозам может быть положен только при условии международного сотрудничества. Мы будем  оказывать содействие расследованию в пределах, установленных швейцарским законодательством.
